Key Terms
- "Cogvein" / "We" / "Us" / "Our" — the workshop operating at Jalan SS15/4B, 47500 Subang Jaya, Selangor, Malaysia.
- "Service" — any watch or clock repair, maintenance, bracelet fabrication or home attendance work carried out by Cogvein.
- "Client" / "You" / "Your" — any individual or entity that engages Cogvein for a Service or uses this website.
- "Piece" — any watch, clock, movement or component brought to or collected by Cogvein in connection with a Service.
- "Condition Note" — a written assessment prepared by Cogvein describing the Piece's condition, proposed work and scope prior to commencement.
- "Agreement" — the binding arrangement formed between Cogvein and the Client when the Client approves the Condition Note and proceeds with a Service.
Agreement Formation
By using this website, submitting an enquiry or approving a Condition Note, you agree to these Terms & Conditions. These Terms apply to all Services provided by Cogvein. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in Malaysia. If you are acting on behalf of an entity, you confirm you have authority to bind that entity.
Services Offered
Cogvein currently offers three defined services:
- Pocket Watch and Heritage Clock Service — bench work on key-wound and lever-set pocket watches, carriage clocks and mantel clocks. Scope: 3–6 weeks. Fee: RM 890.
- Bracelet and Clasp Fabrication — fabrication and fitting of bracelet components. Scope: 3–5 weeks. Two fitting appointments included. Fee: RM 1,720.
- Floor Clock Attendance Programme — in-home service for longcase and wall clocks. Four visits over six months. Telephone support between visits. Fee: RM 3,780.
Service availability is subject to current bench capacity. Cogvein does not operate a walk-in counter and all services commence by enquiry. Services are available to clients in Selangor and the wider Klang Valley; home attendance coverage is confirmed case by case for addresses outside Subang Jaya.
Your Obligations
- Provide accurate and complete information about the Piece at the time of enquiry.
- Disclose any known damage, previous repairs or modifications that may affect bench assessment.
- Respond to Condition Note queries within 14 days. Pieces held without response beyond 30 days may incur a storage charge or be returned.
- Collect or accept return of the Piece within 14 days of notification that the service is complete. Cogvein is not responsible for uncollected pieces held beyond 60 days.
- Use the website only for lawful purposes and not attempt to disrupt or access systems without authorisation.
Website Content
All website content — including text, images, design and branding — is the property of Cogvein or used under licence. You may view and print pages for personal, non-commercial reference only. You may not reproduce, republish or redistribute any content without prior written consent from Cogvein.
Fees and Payment
All fees are denominated in Malaysian Ringgit (RM). Payment is due upon collection of the Piece or at the conclusion of the final visit for the Floor Clock Attendance Programme. Cogvein accepts cash and bank transfer. Pricing stated on this website or in the Condition Note is indicative; the final invoice reflects the agreed scope.
Cancellation: If you cancel a Service after approving the Condition Note but before work commences, no fee is charged. If work has commenced, a pro-rata assessment fee reflecting hours spent on the bench may be invoiced. The Floor Clock Attendance Programme fee for visits already completed is non-refundable.
Out-of-scope work: Any work required beyond the agreed scope is presented to the Client as a separate decision before proceeding. No additional charges are applied without prior approval.
Scope, Timelines and Parts
- Scope and timeline ranges are estimates. Cogvein will communicate promptly if the estimate changes.
- Where a replacement part is used, Cogvein will document in the service record whether the part is original manufacturer stock or a matched-material alternative.
- Cogvein does not warrant that a serviced Piece will achieve any particular rate accuracy, as this depends on the mechanical condition and age of the movement.
- For the Floor Clock Attendance Programme, beat setting is performed in the clock's installed position. The Client is responsible for ensuring the clock's installation location does not change between visits.
Limitations of Service
Services are provided on a best-efforts basis. Cogvein does not make representations that any Piece will achieve a specific outcome after service. Old and worn movements may carry pre-existing faults that cannot be fully corrected by cleaning and adjustment alone. The Condition Note describes what can and cannot be addressed; work outside that scope is not covered by the service fee.
The website is provided for information purposes and does not constitute professional or technical advice about any specific Piece not assessed by Cogvein.
Liability Cap
To the fullest extent permitted by Malaysian law, Cogvein's aggregate liability for any claim arising from or related to a Service is limited to the amount paid for that Service. Cogvein is not liable for indirect, consequential or special losses. Cogvein takes reasonable care in handling Pieces but is not liable for pre-existing damage, wear or deterioration that could not have been prevented by standard bench practices. Force majeure events — including but not limited to natural disasters, fire, flood or government restriction — suspend Cogvein's obligations for the duration of the event.
Your Indemnity
You agree to indemnify and hold Cogvein harmless from any claims, damages or costs arising from (a) your provision of inaccurate information about a Piece, (b) your breach of these Terms, or (c) your misuse of the website or services.
Ending the Agreement
Either party may terminate an Agreement before bench work commences. Cogvein may decline to accept a Piece or discontinue a Service if the Client's instructions are unclear or if the Piece presents a risk to bench equipment or staff. If Cogvein terminates after work has commenced, any work completed will be documented and any applicable pro-rata fee discussed.
Governing Law and Disputes
These Terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to first attempt informal resolution by contacting Cogvein at [email protected]. If informal resolution is not reached within 30 days, disputes shall be submitted to the jurisdiction of the courts of Selangor, Malaysia. The Consumer Protection Act 1999 (Malaysia) applies to consumer transactions where relevant.
Miscellaneous
- Entire agreement: These Terms, together with the Condition Note for a specific Service, constitute the entire agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce a provision does not constitute a waiver of the right to enforce it subsequently.
- Assignment: You may not assign your rights under these Terms without Cogvein's written consent.
- Notices: Communications should be directed to [email protected].
Updates
Cogvein may update these Terms from time to time. The "Last updated" date will reflect revisions. Continued use of the website or engagement of Services after an update constitutes acceptance of the revised Terms.
